1. Agreement to Terms
By accessing or using Built by Brokers ("builtbybrokers.com"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Description of Service
Built by Brokers provides a software-as-a-service platform that allows real estate agents and brokerages to create, manage, and publish real estate websites, including property listings, lead capture tools, and an administrative dashboard ("the Service").
3. Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@builtbybrokers.com if you believe your account has been compromised.
4. Subscription and Payment
Access to paid features requires a valid subscription. Fees are billed on a monthly or annual basis as selected at signup. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days’ written notice.
Failure to pay may result in suspension or termination of your account. Past-due accounts may be charged a late fee.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any regulations
- Post false, misleading, or fraudulent property listings or content
- Scrape, harvest, or systematically collect data from the Service
- Interfere with or disrupt the Service or servers connected to it
- Resell or sublicense access to the Service without written permission
- Violate any applicable real estate laws, MLS rules, or fair housing regulations
6. Content and Data
You retain ownership of content you upload to the Service ("Your Content"). By uploading content, you grant Built by Brokers a limited license to store, display, and transmit that content solely to operate the Service.
You are solely responsible for the accuracy and legality of Your Content, including property listings, images, and lead data. Built by Brokers does not verify listing accuracy.
7. MLS and Third-Party Data
If you connect an MLS feed, you are responsible for complying with your MLS board’s rules, regulations, and data license agreements. Built by Brokers is not responsible for MLS data accuracy, availability, or compliance with your board’s policies.
8. Intellectual Property
The Built by Brokers platform, including its design, code, and documentation, is owned by Built by Brokers and protected by copyright and other intellectual property laws. You may not copy, modify, or create derivative works of the platform without written permission.
9. Termination
Either party may terminate this agreement at any time. Upon termination, your access to the Service will end. You may export your data within 30 days of termination. After that period, we may delete your data from our systems.
10. Disclaimers and Limitation of Liability
The Service is provided "as is" without warranties of any kind. Built by Brokers is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform. Continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
